Select Care
A. All commissions are stated in whole dollars (not percentages). Actual payment will be rounded to be divisible by 12.
B. All commissions may be advanced and/or paid only to agents who are Certified, which means that the agent has
(i) contracted with SelectCare of Texas, L.L.C. ("SelectCare"), (ii) undergone training with respect to the Medicare program and the Select Care MEDICARE ADVANTAGE PLANS, and (iii) successfully taken and passed a test with respect to the Medicare program and the SelectCare MEDICARE ADVANTAGE PLANS. First year commissions may be advanced only on (i) the submission of a fully completed MEDICARE ADVANTAGE PLAN application and (ii) after completion of a phone verification (a "Verified Application"). For a fully completed MEDICARE ADVANTAGE PLAN application received by SelectCare for which no phone verification has been completed, no commission advances shall be due, paid or payable by Select Care for the submitted application. Commission advances will be up to a maximum of twelve (12) months as approved by your manager and Select Care. Commission advances are made or not made at the sole discretion of Select Care. Commissions will be paid on applications that are not Verified Applications and such commissions will be paid "as earned" (i.e., 1/12th, 1/12th, etc.). With respect to multiple applications received for the same Medicare beneficiary, SelectCare shall advance and/or pay commissions only on (i) the first application received by Select Care Home Office, and (ii) from a Certified agent.
C. No interest shall be charged by SelectCare on the debit balance from MEDICARE ADVANTAGE PLAN enrollments.
D. For Issued and Placed Enrollments (as defined herein) where SelectCare receives and retains at least three months of premium, there is no charge back of any of the first year commissions advanced. Notwithstanding the foregoing sentence, there will be full charge back of all first year commissions if (i) CMS rejects the application, or (ii) SelectCare does not retain at least three months of premium from the policyholder and/or CMS, or (iii) CMS permits the enrollee to disenroll based on allegations of agent conduct. All commission charge backs may be charged against the next commission advance, earned commissions or otherwise offset by SelectCare against other compensation due or to become due to you.
