Service Area
The geographic area in which Bravo Health is authorized to offer the Plans and in which Broker may solicit enrollment of Eligible Medicare Beneficiaries under this Agreement.Eligible Medicare Beneficiary
A Medicare eligible individual solicited under this Agreement who:a. is located in the Service Area;
b. is eligible to receive Medicare or Medicare/Medicaid benefits; and
c. is approved by Bravo Health and CMS and is accepted for enrollment under a Medicare Advantage or Medicare PDP Plan issued by Bravo Health
Broker Code of Ethics
The code of ethical conduct that Broker, under this Agreement, agrees to adhere to when acting on behalf of or representing Bravo Health at any time; such code is attached hereto and incorporated herein as Exhibit A of this Agreement. Violation of the Code of Ethics shall be deemed a material breach of this Agreement and shall be considered termination for cause under the terms of this Agreement.Broker
Any employees of the Broker, contracted independent agents, self employed contractors or other contracted status with Broker for the purpose of soliciting Eligible Medicare Beneficiaries for Bravo Health Plans.The Health Insurance Portability and Accountability Act of 1996 and as amended and as implemented by CMS and the U. S. Department of Health and Human Services pursuant to which the Parties agree to the terms and conditions of the Business Associate Addendum, attached hereto and incorporated herein as Exhibit B.
Medicare Advantage
The program for Medicare created under the Balanced Budget Act of 1997 and contained in Title XVIII, Part C of the Social Security Act and the rules and regulations promulgated there under and as amended by the Medicare Prescription Drug, Improvement, and Modernization Act of 2003, or as may be amended from time to time.Bravo Health Commission Payment Policy
Bravo Health policy, as may be amended from time to time, that describes the methodology and timing of Commission payments, including retroactive deductions due to disenrollments, due to/from Broker as defined in this Agreement.Upload Bravo Contract
